Changing or Canceling Paternity in Michigan

 Sometimes, the paperwork says one man is the legal father of a child, but everyone learns later that this is not true. In Michigan, there is a special law that lets families fix this. It is called the Revocation of Parentage Act (or ROPA for short).

"Revocation" is just a big legal word that means canceling or undoing. Undoing legal father status is a big deal, but it is possible with the right help.

What Does it Mean to Undo Legal Father Status?

 

When a court cancels legal father status, it changes two main things:

  1. Rights: The old legal father no longer has a legal right to visit or make decisions for the child.
  2. Support: The old legal father stops being responsible for paying child support in the future.

This process helps make sure the child's paperwork matches real life. It also allows the child's real biological father to step up and have legal rights.

Who Can Ask to Change the Father on Paper?

 Under Michigan law, a few different people can ask a judge to fix this:

  • The Mother: If she wants to establish the biological father as the legal father.
  • The Man Signed on the Papers: If he signed a form called an Affidavit of Parentage but later found out he is not the biological father.
  • The Real Biological Father: If he wants to be recognized as the legal father, even if the mother was married to someone else when the child was born.

Important Rule: In most cases, you must file the paperwork to change paternity before the child turns three years old. If the child is older, a judge might still let you do it, but you have to show a very good reason.
